Finally, the article examines possible paths in the areas of taxation, tariffs, tariffs and trade to provide a comprehensive picture of the current state of the EAC and how these differences threaten its long-term goals.

However, the perception of this authority varies from one Member State to another, which raises serious questions about its effectiveness. Some countries reserve the right to transfer national sovereignty to regional courts, reflecting the delicate balance between regional cooperation and preserving individual state autonomy . The enforcement of EACJ judgments faces challenges as cases of violations undermine the effectiveness of the court. To address these issues, it is essential to create mechanisms that promote better communication and cooperation between the EACJ and its member states . Maintaining this delicate balance ensures the Court’s legitimacy and strengthens the EACJ’s role as a trusted arbiter in the pursuit of regional integration, while recognizing and respecting the diverse perspectives and concerns of individual member states.
Proposing a Way Forward
A comprehensive and collaborative approach is urgently needed to address existing gaps and strengthen the East African Community (EAC) integration agenda. Member States should prioritize open dialogue to coordinate tax policies, tariffs and duties. Establishing a consultative process for major economic decisions can ensure that the interests of all countries are taken into account while promoting a sense of unity and common purpose. In addition, the implementation of a robust dispute resolution mechanism through a strengthened and widely accepted East African Court of Justice (EACJ) would enable effective mediation of disputes and discourage unilateral actions that could undermine broader integration goals. It is also very important to carefully consider the existing legal framework. Identifying and correcting inconsistencies will help create a more cohesive and collaborative legal environment within the EAC. These proactive steps help strengthen the foundation for coordinated regional integration by increasing legal clarity and consistency. By adopting these measures, the EAC can lay the foundations of flexible and organized communities and ensure the achievement of common goals of socio-economic inclusion with high efficiency and stability.
